6 myth busters about Employment Agreements

Whether you are employing a new person, or adjusting your employment agreements to build greater flexibility into your workforce, “Which contract should I use?” is probably the most common question I’m asked.

And here are a few Myth busters:

  1. Zero hours contracts are Illegal.

In 2016 there were a lot of headlines about Zero-hours contracts.  At the time the Employment Relations Amendment Act 2016 was introduced and this made it a requirement for employers to:

  1. Include an availability provision, i.e. when you need them to be available to you.
  2. Have genuine business reasons for including that availability provision.
  3. Give the ability for the employee to refuse work – i.e. you can’t require the employee to be available 24/7 in case you have a shift for them, so, in return they must have the right to refuse offered work without penalty.
  4. Include details about the compensation for that availability, i.e. how much they will be paid for cancelled shifts, how much notice will be given for cancelled shifts etc.

You won’t fully grasp your customers’ objections. You won’t be able to coach and support your sales team if you don’t even have a strategy, let alone a plan. You won’t have a solid process in place to effectively train someone else.

If costs are getting too much don’t leave it too late to restructure

Sadly, I am now starting to have a lot more conversations about the need for downsizing and restructuring.  As a business owner, making people redundant is probably the hardest thing you will ever have to do, so people do put it off, often until it is too late.

But how can I do it, I don’t want to lay anyone off?

Even for me (and I don’t know the people personally) making someone redundant is hard.  However, my self mantra is:

  1. Make sure I am making the right decisions for the right reasons.
  2. Focus on the jobs I am saving, not on those who are being made redundant.
  3. Be as supporting and sympathetic to those who are being made redundant.
